To be an authorized affiliate of Trucking Business and Beyond, dba Let’s Truck, you agree to abide by the terms and conditions contained in this agreement.

Please read this agreement carefully before registering and using Let’s Truck's service as an affiliate. By signing up for our affiliate program, you indicate your acceptance of this agreement and its terms and conditions.
 
JOINING THE PROGRAM
By filling out the signup form, and upon acceptance, you will become an affiliate and are bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise our website to receive a commission on products purchased by your referred individuals.
 
AFFILIATE PAYMENT SCHEDULE
Payment for January is made in late March.
Payment for February is made in late April.
Payment for March is made in late May.
Payment for April is made in late June.
Payment for May is made in late July.
Payment for June is made in late August.
Payment for July is made in late September.
Payment for August is made in late October.
Payment for September is made in late November.
Payment for October is made in late December.
Payment for November is made in late January of the following year (approximately 60 days after Nov. 30).
Payment for December is made in late February of the following year (approximately 60 days after Dec. 31).
 
RIGHTS AND OBLIGATIONS
Let’s Truck maintains the right to audit your site at any time to determine whether you are following the terms and conditions of this Agreement. We may notify you of any changes to your site that we feel should be made, or to make sure that your links to our web site are appropriate. If you decide not make the changes to your site that we feel are necessary, we reserve the right to terminate your participation in our Affiliate Program.

Let’s Truck reserves the right to terminate this Agreement and your participation in our Affiliate Program immediately and without notice to you should you commit fraud in your use of the Affiliate Program or should you abuse this program in any way. If such fraud or abuse is detected, Let’s Truck will not be liable to you for any commissions resulting from fraudulent sales.
 
AFFILIATE RESPONSIBILITIES
It is understood that you will introduce Let’s Truck's products, services, and/or online services to your current and prospective customers and will comply with all laws as well those that govern email marketing and anti-spam laws. Let’s Truck reserves the right to accept or reject any prospective customers and will pay you a commission per customer referred using your affiliate code and/or link according to the designated payment schedule.

You, the Affiliate, are responsible for ensuring the accuracy and appropriateness of material posted to your site.

Either you or Let’s Truck may terminate the Affiliate relationship at any time. You are only eligible to earn Affiliate payments during your time as an approved Affiliate. Let’s Truck may change the program or service policies and operating procedures at any time.
 
AFFILIATE RELATIONSHIP
This Affiliate relationship is one of independent contractors. Let’s Truck will not be liable for indirect, special or consequential damages arising in connection with this program and our aggregate liability arising with respect to this program will not exceed the total referral fees paid or payable to you. Let’s Truck makes no express or implied warranties or representations with respect to the program. In addition, Let’s Truck makes no representation that the operation of the service will be uninterrupted or error-free, and Let’s Truck will not be liable for the consequences of any interruptions or errors.

Let’s Truck is located in the United States and the program is governed by the laws of the United States and the state of Oregon.

REVOCATION OF AFFILIATE STATUS
Your affiliate application and status in the program may be suspended or terminated for any of the following reasons:

Misleading link placement or usage
Spamming (unsolicited email, mass newsgroup posting, pop-ups, etc.)
Usage of program materials on sites which contain or promote illegal activities
Usage of program materials on sites that contain or promote gambling, sexually explicit content, violence, and/or prescription pharmaceuticals (e.g. Viagra)
Incorporating any materials which infringe or assist others to infringe on any copyright, trademark or other intellectual property rights or to violate the law
Inability to setup links or refer clients to Let’s Truck (lack of performance)
Exploitation of affiliate links to gain personal discount
Use of affiliate links in PPC or CPC ads
Misspelling or misrepresentation of Let’s Truck or products
Creating, designing, or operating any domain, website, page, or publication which resembles our website or materials in a manner that may lead customers to believe you are Let’s Truck.
 
AFFILIATE LINKS & MATERIALS
You may use graphic and text links both on your website(s) and in emails. You may use the graphics and text provided to you by us, or you may create your own as long as they are deemed appropriate according to the conditions above.

You are granted a limited, non-exclusive, revocable right to use provided trademarks and 
banners. All images, technology, and content provided for your use is and shall remain the sole property of the Let’s Truck.
 
AFFILIATE TRACKING
When a web surfer clicks through your affiliate link, a cookie is set in their browser that contains your affiliate username. Also, their IP address is tracked in the database along with your affiliate name. When this person decides to buy a product, the script will look for this cookie and/or try to match their IP address to identify the affiliate who will be awarded the commission. Visitors sent through your affiliate link may make a purchase later in time and the commission will still be awarded if the cookie is present in their browser and/or they are using the same IP address as the one logged in the database.
 
TERMS OF THE AGREEMENT
These terms will begin upon your signup with the affiliate program and will end when your affiliate account is terminated. The terms of this agreement may be modified by Let’s Truck at any time. If any modification to the terms is unacceptable to you, your only choice is to terminate your affiliate account. Your continuing participation in the program will constitute your acceptance of any change.
 
MODIFICATION
We may modify any of the terms and conditions in this Agreement at any time at our sole discretion. In such event, you will be alerted prior to your next login. If any modification is unacceptable to you, your only option is to end this Agreement. Your continued participation in Let’s Truck’s Affiliate Program following the posting of the change notice or new Agreement will indicate your agreement to the changes.
 
CONFIDENTIALITY
All confidential information, including, but not limited to, any business, technical, financial, and customer information, disclosed by one party to the other during the effective term of this Agreement which is marked "Confidential," will remain the sole property of the disclosing party, and each party will keep in confidence and not use or disclose such proprietary information of the other party without express written permission of the disclosing party.
 
LIABILITY
We will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of "intents of harm" to the program or our website. We do not make any expressed or implied warranties with respect to the affiliate program and/or products sold at this site. We make no claim that the operation of the affiliate program and our website will be error-free and we will not be liable for any interruptions or errors.
